Matthias Braun, address as above
LIABILITY FOR CONTENT
As a service provider, we are responsible for our own content on these
pages in accordance with § 7(1) DDG (German Digital Services Act) and
general law. Under §§ 8 to 10 DDG, however, we are not obligated to
monitor transmitted or stored third-party information, or to investigate
circumstances that indicate unlawful activity. Obligations to remove or
block the use of information under general law remain unaffected. Liability
in this respect is only possible from the point at which a concrete
infringement becomes known. Upon notification of such violations, we will
remove the content concerned without delay.
LIABILITY FOR LINKS
Our site contains links to external third-party websites over whose content
we have no control. We therefore accept no liability for this external
content. The respective provider or operator of the linked pages is always
responsible for their content. The linked pages were checked for possible
legal violations at the time of linking; no unlawful content was apparent.
Permanent monitoring of the content of linked pages is not reasonable
without concrete evidence of an infringement. Upon notification of
violations, we will remove such links without delay.

We take the protection of your personal data seriously. Use of our website
is generally possible without providing personal data. Where personal data
is processed, this is done only where necessary and on a valid legal basis.
HOSTING (SQUARESPACE)
This website is hosted on the platform of Squarespace Ireland Limited, Le
Pole House, Ship Street Great, Dublin 8, D08 H8RW, Ireland ("Squarespace").
When you visit the site, Squarespace processes personal data on our behalf,
including the data described in this policy (in particular server log data,
data entered into forms, and analytics data). We have concluded a data
processing agreement with Squarespace, which is incorporated into
Squarespace's Terms of Service and ensures that your data is processed only
in accordance with our instructions and the GDPR. The legal basis for using
Squarespace is Art. 6(1)(f) GDPR; our legitimate interest lies in the
reliable and secure provision of our website.
Squarespace may transfer personal data to its parent company, Squarespace,
Inc., in the USA. Squarespace, Inc. is certified under the EU-US Data
Privacy Framework, so the transfer takes place on the basis of the European
Commission's adequacy decision under Art. 45 GDPR.
SERVER LOG FILES
When you access our site, the provider automatically collects and stores
information in server log files that your browser transmits: browser type
and version, operating system, referrer URL, IP address, and the time of
the request. This data is not merged with other data sources. The legal
basis is Art. 6(1)(f) GDPR; our legitimate interest lies in the technically
error-free presentation and security of our website.
COOKIES
Our site uses cookies. Cookies that are strictly necessary for the
operation of the site are stored on the basis of Art. 6(1)(f) GDPR
(legitimate interest in a functioning website). Any cookies that are not
strictly necessary are set only with your consent under § 25(1) TDDDG in
conjunction with Art. 6(1)(a) GDPR. You can configure your browser to
refuse cookies or to alert you when cookies are being sent; disabling
cookies may limit the functionality of this site.
SQUARESPACE ANALYTICS
Our hosting provider Squarespace (Squarespace Ireland Limited) provides
built-in analytics that help us understand how our website is used, for
example the number of visitors, pages viewed, and the general region from
which visits originate. For this purpose Squarespace uses cookies and
similar technologies and processes data such as IP addresses (shortened
where possible) and access times. The data is used to evaluate and improve
our website and is not used to identify individual visitors personally. The
legal basis is Art. 6(1)(f) GDPR; our legitimate interest lies in the
needs-based design and ongoing improvement of our website. Details of
Squarespace's data processing are available in Squarespace's own privacy
policy at https://www.squarespace.com/privacy.
NEWSLETTER
If you wish to receive our newsletter, we require a valid email address.
Registration uses the Double-Opt-In procedure: after signing up, you
receive a confirmation email and your subscription becomes active only once
you confirm it. We store your IP address and the times of registration and
confirmation to document the process. The legal basis is your consent under
Art. 6(1)(a) GDPR. You may withdraw your consent at any time, for example
via the unsubscribe link in every newsletter; withdrawal does not affect
the lawfulness of processing carried out before it.
Our newsletters contain a tracking pixel that allows us to see whether and
when a newsletter was opened and which links were clicked. This analysis is
carried out on the basis of your consent under Art. 6(1)(a) GDPR and can be
withdrawn at any time via the unsubscribe link.
BLOG COMMENTS
When you comment on our blog, we store your username, the time of the
comment, and your IP address. The username and comment are published; the
IP address is stored for our security and legal protection in case the
comment infringes the rights of third parties. The legal basis is
Art. 6(1)(f) GDPR (legitimate interest in defending against legal claims).
CONTACT BY EMAIL OR CONTACT FORM
If you contact us by email or via a contact form, the details you provide
are stored for the purpose of handling your enquiry and any follow-up
questions. We do not pass this data on without your consent. The legal
basis is Art. 6(1)(b) GDPR where your request relates to a contract or
pre-contractual measures, and otherwise Art. 6(1)(f) GDPR (legitimate
interest in responding to enquiries).
COORDINATION VIA WHATSAPP
For organisational coordination with participants (rehearsal times,
performance logistics, etc.), we use the messenger service WhatsApp,
provided by Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand
Canal Harbour, Dublin 2, Ireland. Messages and metadata (in particular
phone numbers and timestamps) are transmitted to and processed on Meta's
servers.
The legal basis is Art. 6(1)(b) GDPR (necessity for performing a
cooperation arrangement) and Art. 6(1)(f) GDPR (legitimate interest in
efficient and timely communication with participants).
The transfer of personal data to the USA takes place on the basis of the
European Commission's adequacy decision on the EU-US Data Privacy Framework
(Art. 45 GDPR); Meta Platforms is certified under the DPF.
Participants who prefer to be contacted by email may indicate this at any
time at info@kryptoniteradio.com.
DATA RETENTION
We store personal data only as long as necessary for the purposes stated
above or as required by statutory retention periods. Once the purpose
ceases and no retention obligation applies, the data is routinely deleted.
YOUR RIGHTS
You have the right to obtain confirmation as to whether we process personal
data concerning you, and to access that data (Art. 15 GDPR), as well as the
rights to rectification (Art. 16), erasure (Art. 17), restriction of
processing (Art. 18), data portability (Art. 20), and to object to
processing (Art. 21). Where processing is based on consent, you may
withdraw that consent at any time with effect for the future. To exercise
these rights, contact us at info@kryptoniteradio.com.
You also have the right to lodge a complaint with a data protection
supervisory authority. The authority competent for us is:
Der Hessische Beauftragte für Datenschutz und Informationsfreiheit
Postfach 3163, 65021 Wiesbaden

AUTOMATED DECISION-MAKING
We do not use automated decision-making or profiling within the meaning of
Art. 22 GDPR.
